3. Australian Territory and Jurisdiction

We only sell and ship products to addresses located within Australia. These Terms and Conditions are governed by the laws of New South Wales and the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales in connection with any dispute arising under these terms.

4. Orders and Accounts

You may purchase as a guest or by creating an account. You agree to provide accurate, complete, and current information at all times. An order is accepted when we issue an order confirmation and/or dispatch notification. Title to goods passes to you upon receipt of full payment. If an order is cancelled prior to dispatch, a refund will be issued to your original payment method.

All prices are displayed in Australian dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice for future orders. Payment must be made using the methods offered at checkout. All credit card and payment data is processed via secure, encrypted payment processing and is not stored by The Cigar & Scotch Co.

6. Shipping, Delivery and Risk

Orders are generally dispatched within two business days of payment confirmation. Risk of loss or damage passes to you upon delivery. We are not liable for delays caused by our carrier partners, public holidays, or circumstances outside our control. For orders containing age-restricted products, our carriers may require a signature and proof of age upon delivery. Refusal to provide identification may result in the parcel being returned, and the order may be cancelled.

7. Returns, Refunds and Cancellations

Due to the nature of tobacco products and premium spirits, we generally do not accept returns for change of mind once a product has been dispatched, except as required under the Australian Consumer Law. If you receive a faulty or damaged item, please contact us promptly with details and supporting images. Opened products or items that have not been stored appropriately are not eligible for return unless defective under the Australian Consumer Law. Pre-dispatch cancellations will be refunded to the original payment method, minus any non-recoverable transaction fees where permitted by law.

8. Product Information and Use

We take care to ensure product descriptions and images are accurate; however, minor variations may occur. All flavour notes, strength indicators, tasting descriptions, and pairing suggestions are subjective and provided for general guidance only. Products are intended for personal use only — resale is strictly prohibited. Tobacco products contain nicotine, which is an addictive substance and carries serious health risks. Premium spirits contain alcohol and should be consumed responsibly.
